1. About These Terms

These Terms govern access to and use of the NavSCORA™ website, applications and related services, including MarineOS™ and RCF Runsheet™.

These Terms are between you and NavScora Pty Ltd (NavSCORA, we, us or our), ABN 73 702 089 021, Queensland, Australia.

NavSCORA™ services include the public NavSCORA™ website (navscora.com), the MarineOS™ platform, and customised software solutions developed by NavSCORA™ (such as RCF Runsheet™, developed for RiverCity Ferries). MarineOS™ and RCF Runsheet™ are separate products and are not part of the same platform.

By accessing or using a NavSCORA™ service, you agree to these Terms where legally applicable.

2. Purpose

NavSCORA™ develops software intended to assist maritime organisations and personnel with activities such as:

  • vessel operations;
  • runsheets and schedules;
  • operational information;
  • safety management;
  • compliance;
  • vessel logbooks;
  • training;
  • fatigue management;
  • operational monitoring; and
  • related maritime workflows.

Individual products may have additional terms or contractual arrangements.

3. Authorised Use

You must only use a NavSCORA™ product if you are authorised to do so.

You are responsible for:

  • maintaining the security of your account;
  • providing accurate information;
  • complying with your organisation's procedures;
  • using the software lawfully;
  • protecting login credentials; and
  • immediately reporting suspected unauthorised access.

You must not attempt to bypass security controls, gain unauthorised access, interfere with the service, introduce malicious software, or use NavSCORA™ systems for unlawful purposes.

4. Operational Decision-Making

NavSCORA™ products are designed to support, not replace, professional maritime judgement.

Users remain responsible for maintaining situational awareness and complying with:

  • applicable maritime law;
  • vessel procedures;
  • the vessel's Safety Management System;
  • lawful instructions;
  • navigation requirements;
  • workplace safety requirements; and
  • directions from relevant authorities.

Where application information conflicts with an official instruction, approved operational procedure, navigational requirement or applicable law, the appropriate authoritative requirement takes precedence.

5. Safety-Critical Use

NavSCORA™ software must not be treated as the sole source of information for navigation, collision avoidance, emergency response or other safety-critical decisions unless a particular system has expressly been approved and certified for that purpose.

Users must continue to use required navigation equipment, official information, approved procedures and professional judgement.

6. Compliance Information

NavSCORA™ products may provide tools designed to assist users with Australian maritime safety and regulatory requirements.

References to legislation, standards, guidance or regulatory requirements are provided as operational assistance and do not constitute legal or regulatory advice.

Regulations and official guidance may change.

Users and vessel operators remain responsible for determining which requirements apply to their operations and for maintaining regulatory compliance.

7. MarineOS™

MarineOS™ is intended to assist maritime operators with safety management, compliance, vessel records, crew management, training, fatigue management and related operational activities.

MarineOS™ does not replace an operator's legal responsibility to establish, implement and maintain an appropriate Safety Management System or comply with applicable maritime legislation.

Compliance assessments, alerts, recommendations or indicators generated by MarineOS™ should be considered decision-support information rather than regulatory certification.

8. Fatigue Management

Where MarineOS™ provides fatigue calculations, rest-period analysis, alerts or compliance indicators, these features depend upon the accuracy and completeness of the information supplied to the system.

Fatigue-management outputs are intended to assist responsible personnel in identifying potential issues.

They do not replace an individual's responsibility to report fatigue or an operator's responsibility to manage fatigue risks appropriately.

9. RCF Runsheet™

RCF Runsheet™ is a customised operational software solution developed by NavSCORA™ for RiverCity Ferries. It is separate from, and not part of, the MarineOS™ platform.

RCF Runsheet™ provides operational runsheet functionality that may include schedules, shift instructions, vessel movements, location-based functionality and other operational information.

Schedule, GPS and automated event information may be affected by:

  • device accuracy;
  • GPS availability;
  • network connectivity;
  • system availability;
  • source-data accuracy;
  • timetable changes; and
  • other technical or operational conditions.

Users must verify critical operational information where appropriate.

10. Third-Party Information

NavSCORA™ products may display, process or integrate information obtained from third parties.

NavSCORA™ does not control the accuracy, availability or continued operation of third-party systems and data sources.

11. Availability

We aim to provide reliable services but cannot guarantee that NavSCORA™ products will operate continuously or without error.

Services may occasionally be unavailable because of:

  • maintenance;
  • upgrades;
  • internet or network failures;
  • hosting failures;
  • third-party service interruptions;
  • device issues;
  • cybersecurity events; or
  • circumstances outside our reasonable control.

12. Intellectual Property

Unless otherwise agreed in writing, the NavSCORA™ platform, software, interfaces, designs, documentation, branding and original technology are protected by applicable intellectual property laws.

Operational information belonging to a customer or organisation remains subject to that organisation's rights.

No transfer of intellectual property ownership occurs merely because a person or organisation uses a NavSCORA™ service.

13. Feedback

Users may provide suggestions, operational feedback and ideas to improve NavSCORA™ products.

Unless otherwise agreed, NavSCORA™ may use general feedback to develop and improve its products, provided that confidential information and third-party intellectual property rights are respected.

14. Confidentiality

Users must respect confidential operational, commercial, employee and vessel information accessible through NavSCORA™ products.

Access to information through an application does not automatically grant permission to disclose that information to others.

15. Privacy

Personal information is handled in accordance with the NavSCORA™ Privacy Policy and any applicable customer agreements or product-specific privacy notices.

16. Suspension and Termination

Access may be suspended or terminated where reasonably necessary because of:

  • security concerns;
  • unauthorised access;
  • misuse;
  • breach of these Terms;
  • contractual termination; or
  • legal requirements.

17. Disclaimer

To the extent permitted by law, NavSCORA™ services are provided without guarantees that they will be uninterrupted, completely error-free or suitable for every operational circumstance.

Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded under Australian law.

18. Liability

To the extent permitted by law, NavSCORA™ is not responsible for loss arising solely from reliance on software where professional verification, regulatory requirements, official information or established operational procedures should reasonably have been used.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

19. Governing Law

These Terms are governed by the laws applicable in Queensland, Australia.

Subject to any mandatory legal rights that apply, disputes relating to these Terms will be subject to the jurisdiction of the courts of Queensland and applicable Commonwealth courts.

20. Changes

These Terms may be updated as NavSCORA™ products, services, business structure or legal obligations evolve.

Material changes will be reflected by updating the version or effective date published with these Terms.
